These Terms of Use govern access to FLEXY’s website, business workspace, APIs, and customer booking portals. By using the service, you agree to these terms.

The service

FLEXY provides online appointment scheduling, staff calendars, customer portals, class scheduling, reminders, and related tools for service businesses.

We may change features, limits, or availability with reasonable notice where practical.

Accounts

Business users must provide accurate registration information and keep credentials secure. You are responsible for activity under your account.

You must be authorized to act on behalf of the business you register.

Business responsibilities

If you operate a workspace, you are responsible for your staff, services, pricing, availability, and how you treat customer data.

You must have a lawful basis to collect and use customer information entered into your workspace and portals.

You must publish appropriate notices to your customers where required by law (privacy, terms, cookies for your portal).

Customer portal use

End customers use portals at the invitation of a participating business. Bookings and communications are primarily between the customer and that business.

Do not misuse portals (false bookings, harassment, scraping, or attempts to disrupt the service).

Acceptable use

You may not use FLEXY to violate law, infringe intellectual property, send spam, distribute malware, or probe systems without permission.

We may suspend or terminate access for violations or risk to the platform or other users.

Intellectual property

FLEXY and its branding, software, and documentation are owned by us or our licensors. We grant you a limited, non-exclusive license to use the service during an active subscription or trial.

You retain ownership of content you upload; you grant us rights to host and process it to operate the service.

Disclaimers

The service is provided “as is” and “as available” without warranties of uninterrupted or error-free operation, or fitness for a particular purpose, to the extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits arising from use of the service.

Our total liability for claims relating to the service is limited to the greater of amounts you paid us in the twelve months before the claim or one hundred USD, unless law requires otherwise.

Termination

You may stop using the service at any time. We may suspend or end access for breach, non-payment, or discontinuation of the product with notice where reasonable.

Governing law

These terms are governed by the laws applicable to the operator of FLEXY, without regard to conflict-of-law rules. Courts in that jurisdiction may have exclusive venue unless mandatory consumer protections apply where you live.
